Estate sues over man's allegedly fatal fall in rehabilitation center

BECKLEY -- A man's estate is suing after he experienced several falls in a nursing home, the last of which allegedly caused his death.

Janice Claudine Knepp, as executor of the estate of Thomas William Knepp, filed a complaint May 28 in Raleigh Circuit Court against Beckley Health Partners Ltd., doing business as the Greystone Inn; Chancellor Senior Management Ltd. and Stephanie Compton.

The deceased resided at the defendant's facility from March 26 to July 29, 2014. The lawsuit states that the defendants "deviated from the applicable standard of care" when they allowed the deceased to experience numerous falls in July, culminating in his final, fatal fall on July 25, "from which he developed a brain hemorrhage which in turn caused his death on Aug. 1, 2014."

The plaintiff, citing breaches of their standards of care, wrongful death, negligence and violations of state professional standards, seeks unspecified punitive damages, court costs and attorneys' fees.

The plaintiff is represented by Jonathan R. Mani and Damon Ellis of Mani, Ellis and Layne PLLC in Charleston.
