WHEELING -- A site manger is suing his former employer, alleging it deprived its workforce of required breaks.
Andrew E. Bradley and others filed a class action complaint June 5 in Ohio Circuit Court against JAK Productions Inc., Erik S. McGee and John Keller.
According to the complaint, Bradley worked as a site manager for the defendants until shortly after complaining about the defendants' violations of state law concerning required employee breaks. The suit says the defendants would require workers to skip breaks to work, but still "deceivingly alter time cards and deduct wages as if employees had taken a break."
The lawsuit states Bradley was terminated March 4, about two months after Bradley had renewed his complaint about what the lawsuit refers to as "fake breaking." All of Bradley's former co-workers are included in the class action.
The plaintiff alleges violation of state law regulating workplace policy and asks the court to declare this an official class action.
Bradley seeks unspecified damages, injunctive relief, attorney fees and court costs. He is represented by attorneys Rodney A. Smith, Jonathan R. Marshall and Tony L. Clackler of Bailey and Glasser in Charleston, and Todd S. Bailess and Joy B. Mega of Bailess Law in Charleston.
