Toledo lender sues Wheeling hardware store, alleging default on loan

WHEELING -- A Toledo, Ohio, company is suing a Wheeling hardware store and its owner for allegedly defaulting on a loan.

Bostwick-Braun Co. filed a lawsuit Aug. 5 in Ohio Circuit Court against Double R & K, doing business as Brown Pro Hardware, and Richard S. Brown.

According to the complaint, on March 16, 2012, Bostwick-Braun executed a promissory note for $55,212.25 to the defendants, which were required to pay back the sum on a monthly basis. The defendants have made payments of only $2,795.36, the lawsuit states.

Bostwick-Braun seeks the balance due of $53,320.13, as well as the interest of 9.9 percent per annum from July 20, 2012, forward as well as court costs. It is represented by attorney John R. Keating of Amato Keating and Lessa in Bethlehem, Pa.
