Wheeling couple accuses Yost Contracting of fraud, shoddy work

WHEELING -- A Wheeling couple is suing and contractor and subcontractors, alleging fraud and shoddy workmanship.

Richard and Deborah Greene filed a lawsuit July 31 in Ohio Circuit Court against Yost Contracting, Russell Yost, and several unknown businesses, partnerships, aliases and individuals doing business with Yost.

According to the lawsuit, Yost and the other defendants "solicit and lure unsuspecting customers into fraudulent transactions in West Virginia by home visits, phone calls and other deceptive practices."

The suit says on July 31, 2014, the Greenes executed a contract with Yost and the others for the defendants to sell "certain goods" and perform remodeling work on the Greenes' home. The plaintiffs paid a down payment of $4,500, the lawsuit states, but the goods delivered were of "insufficient quality" and the work that was done was "poor, shoddy and frankly embarrassing."

"This was particularly embarrassing for the Greenes because not only did the house look silly and ill-kept," the lawsuit states, "parts of the roof that Yost managed to tack up on the Greenes' home blew off into the neighbor's yard and the Greenes' yard."

The plaintiffs allege breach of contract, violation of contractor licensing and the West Virginia Consumer Credit Protection Act, fraud, and obtaining money under false pretenses and deceptive practices, negligence, conversion.

The Greenes seek unspecified contractual damages and financial recompense, as well as attorney fees and court costs. The plaintiffs are represented by attorney Mark A. Kepple of Bailey and Wyant in Wheeling.
