Mercer County woman sues doctor, alleging unnecessary hip replacement

PRINCETON -- A Mercer County woman is suing a local doctor and his practice, alleging they performed an unnecessary hip replacement.

Rebecca Nelson filed a lawsuit Aug. 14 in Mercer Circuit Court against Bluefield Clinic Co., Bluefield Orthopedics and Dr. Gary P. McCarthy.

According to the complaint, on Aug. 13, 2013, the defendants performed a total left hip replacement on Nelson 39, at Bluefield Regional Hospital, where she recovered until Aug. 16, 2013. Previously, the plaintiff was told the procedure would have to be performed to "substantially eliminate" her pain, the lawsuit states.

"The plaintiff was not provided with sufficient information to pursue more conservative treatment and testing to rule out or diagnose alternative conditions creating her pain which was not remedied with the total hip replacement surgery and treatment thereafter," the lawsuit states.

As a result, the suit states, the plaintiff continues to suffer from pain and was made to undergo an unnecessary surgery.

Nelson seeks unspecified damages, plus pre- and post-judgment interest and court costs. She is represented by attorney Anthony R. Veneri of Veneri Law Offices in Princeton.
