Mercer Co. man sues Bluefield police force, city

PRINCETON -- A Mercer County man is suing the city of Bluefield and its police force, alleging brutality during an arrest for charges that were ultimately dropped.

Kelly Henderson Sr. filed a lawsuit Aug. 6 in Mercer Circuit Court against Bluefield City Police Department and the city of Bluefield.

According to the complaint, on Nov. 30, 2014, Bluefield police officers came to Henderson home and "beat him during an arrest." The suit says that day, criminal proceedings began against the plaintiff, charged with domestic battery involving a weapon.

However, Henderson ultimately was found not guilty of that charge and the case was dismissed, the lawsuit states. As a result of the alleged battery upon arrest, the suit states, Henderson suffered contusions on his head, damage to his face, teeth and ribs, and medical expenses.

The plaintiff alleges torts of slander, libel and malicious prosecution.

Henderson seeks unspecified compensatory, statutory and punitive damages, lost wages, attorney fees and court costs. He is represented by attorney Anthony M. Salvatore of Hewitt & Salvatore in Beckley.
