Wheeling nurse sues Reynolds Hospital, alleging wrongful termination

MOUNDSVILLE -- A Wheeling nurse is suing her former employer, alleging it terminated her after a series of workplace injuries.

Jo Ann L. Slie filed a lawsuit July 31 in Marshall Circuit Court against Reynolds Memorial Hospital Inc. of Glen Dale.

According to the complaint, Slie started working as a registered for the defendant in October 2002. The suit says on on April 4, 2013, she injured her back while lifting a patient onto a bed.

After the injury, she filed a claim under the Workers' Compensation Act and was awarded a claim number. Then, on July 21, 2013, the suit says, Slie hurt her back and right hip when she was injured at work after falling on a slippery floor. This time, the lawsuit states, the defendant's agent told Slie not to go to the emergency room "because the injuries she suffered as a result of the fall would be covered by her existing workers' compensation claim."

Slie was terminated Aug. 5, 2013, "on the pretext of falsification of records because she allegedly put the wrong date on a minimum data set assessment, the complaint says. On that day, Slie says she was replaced by a 25-year-old nurse with only two years of experience as a floor nurse.

The plaintiff alleges workers' compensation discrimination, age discrimination and tort of outrage.

Slie seeks punitive damages, pre- and post-judgment interest, court costs and attorney fees. She is represented by attorneys Kevin M. Pearl and Carl A. Frankovitch of Frankovitch, Anetakis, Colantonio & Simon in Weirton.
