Atlanta business says Fertig Cabinet failed to pay credit bill

MOOREFIELD -- An Atlanta-based business is suing a Moorefield cabinetry company, alleging an unpaid credit balance.

Bluelinx Corp., of Atlanta, filed a lawsuit Aug. 5 in Hardy Circiut Court against Fertig Cabinet Co. Inc. of Moorefield.

According to the complaint, on June 2, 2002, Sue Williams, as treasurer and secretary of Fertig Cabinet, submitted an application for credit to Bluenix in order to buy certain materials on credit. Over the intervening years, the suit says, Fertig Cabinet has ordered and received numerous goods from the plaintiff but a balance of $6,061.03, is still owed.

The plaintiff alleges breach of contract and unjust enrichment.

Bluelinx Corp seeks 18 percent interest per annum since April 23, 2014, as well as attorney fees and court costs. It is represented by attorney John R. Keating of Amato Keating and Lessa in Bethlehem, Pa.
