RIPLEY -- A Ravenswood company is suing a scrap business for allegedly hauling away scrap but not paying for it.
Constellium Rolled Products Ravenswood filed a lawsuit Aug. 3 in Jackson Circuit Court against C and R Scrap Services, of London, W. Va., alleging non-payment.
According to the complaint, in September 2014, C and R owners Christopher and Robert Rider were informed that they'd won the bid to scrap motor-generator sets at the plaintiff's Ravenswood facility.
By Nov. 2, 2014, the scrap was hauled away, the suit says, but Constellium is still owed the outstanding balance of $215,952.84. In April 2015, the lawsuit states Robert Rider allegedly informed Constellium that "he would pull all the relevant paperwork, that he was 'working on' payment, that scrap prices went down after he took delivery of the scrap, and that he had not sold any of the scrap copper."
Constellium Rolled Products seeks return of the unsold scrap, at C and R's cost, and to be paid the difference between the value of the unsold scrap and the unpaid balance.
It is represented by attorneys Christopher L. Slaughter and Jami K. Suver of Steptoe and Johnson in Huntington.
Jackson Circuit Court case number 15C106.
