Weirton employee sues supervisor, alleging disclosure of disciplinary action

NEW CUMBERLAND -- An employee of the state's Department of Health and Human Services is suing his supervisor for allegedly revealing to other employees the nature of a disciplinary action against the plaintiff.

David A. Mendenhall filed a lawsuit July 29 in Hancock Circuit Court against the West Virginia Department of Health and Human Services.

According to the complaint, Menderhall worked for the DHHR in Weirton for the Bureau for Children and Families, and on March 2, 2012, he was disciplined by his supervisor. The lawsuit states five days later, the supervisor "negligently, recklessly and carelessly" disclosed to other employees the nature of the disciplinary action, which the plaintiff alleges should have remained confidential.

Mendenhall seeks unspecified damages in excess of the court's jurisdictional limits, plus costs. He is represented by attorney Daniel L. McCune of Sellitti, Nogay and McCune in Weirton.
