Former DHHR employee alleges wrongful termination despite approved medical leave

CHARLESTON – A former state employee is suing over charges that he was wrongfully terminated.

Hamada E. Mahmoud filed the suit Sept. 3 in Kanawha Circuit Court against the West Virginia Department of Health and Human Resources.

According to the complaint, the plaintiff had worked in the office of the chief medical examiner for 12 years. While still employed there, the plaintiff was approved for medical leave based on a doctor's recommendation. He says that four days after his leave was approved by his supervisor, the defendant terminated him on Sept. 5, 2013.

The plaintiff is charging retaliation and violation of the Family and Medical Leave Act.

The plaintiff seeks financial damages, interest, court costs attorney's fees and a trial by jury.

The plaintiff's attorney is Clinton W. Smith of Charleston. The case has been assigned to Circuit Judge Jennifer F. Bailey.
