Fayette Co. woman blames Kmart in slip-and-fall suit

CHARLESTON– A Fayette County woman is suing Kmart over alleged injuries she sustained after falling at one of its stores.

Amanda Crow filed a lawsuit in Kanawha Circuit Court against SHC Promotions LLC, doing business as Kmart Corp., citing negligence and breach of duty.

According to the complaint, Crow was shopping at a Kmart in Charleston on around Aug. 30, 2013, when she slipped on a wet concrete floor while exiting the store's restroom and became unconscious after hitting her head on the floor. When she tried to stand up after regaining consciousness she slipped and fell again.

The suit states the defendant failed to ensure its premises was in a reasonably safe condition, as well as failed to warn individuals walking about the property of any potential unsafe conditions.

Crow claims she has endured physical pain, emotional distress, mental anguish, loss of life's enjoyment, inconvenience, medical expenses and loss of income.

Crow seeks damages, plus attorney fees, court costs and other relief deemed appropriate by the court. She is  represented by attorney Michael L. Myers of Myers and Perfater in Charleston. The case has been assigned to Circuit Judge Jennifer F. Bailey.
