Vacated Fayette Town Center space leads to breach of lease suit

FAYETTEVILLE – A Greenville, S.C. property management company is suing over an allegedly unpaid lease and damage done to the commercial space.

TIC Properties Management filed the suit Sept. 4 in Fayette Circuit Court against The County Shop and Donald Snyder.

According to the complaint, on Jan. 25, 2013, the defendants entered into a retail lease agreement with the plaintiff for a 1,600-square-foot space located in Fayette Town Center. Three months later in April, the plaintiff claims the defendants left the premises without notice and also left some damages behind, including plumbing issues and missing ceiling tiles, which the plaintiff says the defendants took with them. The plaintiff made all the repairs, the cost of which are part of this suit.

Because of the breach of lease, the plaintiff seeks monetary judgment against the defendants, including the property damage, late fees, past due rent and interest. The suit also calls for the payment of attorneys' fees and court costs.

Attorneys for the plaintiff are Jared M. Tully and Elizabeth A. Moore of Frost Brown Todd in Charleston. The case has been assigned to Circuit Judge John W. Hatcher Jr.
