Pennsylvania man sues developer, alleging breach of agreement

ROMNEY--A Pennsylvania man is suing a developer, alleging breach of a sales agreement relating to a real estate development deal.

Edward W. Weed, of Hanover, Pa., filed the lawsuit Sept. 3 in Hampshire Circuit Court against WV Hunter in Martinsburg.

According to the complaint, on July 26, 2008, WV Hunter, the developer of a subdivision named Bluffs on the Potomac, sold lot 182 to Weed for $119,900. As part of the sales agreement, the suit says, the defendant had to pay a one-time fee of $6,000 per lot to Allegheny Power.

Even though Weed completed payment on the lot Aug. 15, 2008, the plaintiff says the defendant has yet to pay for the electricity hookup. As a result, the plaintiff says it considers WV Hunter to be in breach of the sales agreement.

Weed asks the court to order the defendant to perform its obligations and seeks damages for emotional distress and aggravation, as well as economic damages, court costs and attorney fees. He is represented by attorney Jack H. Walters of Walters & Heishman in Moorefield. Circuit Judge Charles E. Parsons has been assigned the case.
