Davis H. Elliot Construction Co. sued over alleged wrongful termination

WINFIELD – A Lincoln County man is suing a Putnam County construction company over allegations of unfair termination.

Shannon L. Meade filed a lawsuit in Putnam Circuit Court on Sept. 18 against Davis H. Elliot Construction Co. Inc. over violations of West Virginia Wage Payment and Collection Act (WVWPCA) and disability discrimination.

Meade alleges that he was employed by defendant from Feb. 2 to June. During that time he suffered four heart attacks and was fitted with a pacemaker. Meade claims he was still able to work but on or about June 10, he was taken aside and advised by his supervisor he was terminated. Meade allegedly tried to file for unemployment and was notified that he was terminated for not having the tools which were required for the job. He argues that he was still capable and the reason for his termination, his disability, violated the West Virginia Human Rights Act. Following his termination, Meade alleges that defendant improperly made deductions and was late on payment of final wages, which violated the WVWPCA.

Meade is suing for compensatory and punitive damages, including lost wages, benefits and front pay, damages for emotional distress, attorney fees and costs, and all other relief deem just by the court. He is being represented by attorney Richard W. Walters of Shaffer & Shaffer PLLC in Charleston. The case has been assigned to Circuit Judge Phillip M. Stowers.
