Sherwin-Williams sues for thousands of dollars in back pay

MOOREFIELD – Popular paint company Sherwin-Williams is suing a paint company and its owner for thousands of dollars in back pay.

The Sherwin-Williams Co. filed a lawsuit Aug. 31 in Hardy Circuit Court against Melco Painting Inc. and Aaron W. Himes claiming they defaulted on an agreed upon payment plan.

Sherwin-Williams claims Melco agreed to make monthly payments for goods and services provided by the company, and goes on to allege Melco failed to make all agreed upon payments. The terms of the note were from March 28, 2012, to Feb. 28, 2014, for a total of $111,448.79.

Sherwin-Williams is asking for judgment of $50,916.21, the remaining balance, from the defendants, plus post-judgment interest, costs of this action, and any such relief the court deems appropriate. Sherwin-Williams is represented Ryan S. Marsteller of Bailes, Craig, & Yon, PLLC in Huntington. The case has been assigned to Circuit Judge J. Charles Carl III.
