Ohio Valley Realty Co. sues neighbors, Wheeling over allegedly hindering demolition

WHEELING – A realty company has filed a lawsuit claiming neighbors are hindering a court-ordered demolition. 

Ohio Valley Realty Co. filed a lawsuit Sept. 3 in Ohio Circuit Court against McCoy Wealth Management LLC, Tim Roberts, Grove & Delk PLLC, and the city of Wheeling, claiming it is being hindered from completing necessary demolition on a property.

According to the complaint, Ohio Valley Realty Co. claims it is working to comply with a court order to demolish buildings located at 50 and 52 15th Street, and have continued to receive resistance from surrounding property owners and leasers of land. Ohio Valley claims the city found replacement parking and offered monetary compensation of $1,500 per month for any inconveniences incurred during demolition to the defendants. The company claims the defendants rejected the parking option and demanded more money in compensation. The company goes on to allege that its demolition contractors have been threatened with trespassing actions.

Ohio Valley is seeking an order to permit its contractors on the property and to temporarily use the defendants' property for the purpose of the demolition, as well as a reasonable compensation. Ohio Valley is represented by Frank X. Duff of Schrader Byrd, & Companion in Wheeling. The case has been assigned to Circuit Judge James P. Mazzone.
