Couple sues Ultimate & Classic Designs Inc. over claims of lack of handicap accessible craftsmanship

BECKLEY – A couple is suing a construction company claiming their handicap needs were ignored during home construction.

Jack and Frieda Bond filed a lawsuit July 29 in Raleigh Circuit Court against Ultimate & Classic Designs Inc. and Douglas Lilly, claiming the agreed upon construction contract they entered into was not properly executed with respect to their handicap needs.

The Bonds claim on Aug. 26, 2013, they entered into an agreement with the company to build a home in Daniels with specific requirements to meet their needs. They allege the company proposed a house site located at 330 Chapelwood Drive that the company claimed would be handicap accessible. The couple claims once the home was built in 2014, they found the house site and the home was not easily accessible by wheelchair, improper installation on a number of fixtures, and was lacking in several specific areas they had agreed upon with the company.

The Bonds ask to recover the $400,000 for the cost of the home, pre- and post-judgment interest, all costs and attorney's fees, as well as further relief the court sees fit. The Bonds are represented by James R. Sheatsley of Gorman, Sheatsley & Co. in Beckley. The case has been assigned to Circuit Judge H. L. Kirkpatrick III.
