Client sues Nationwide Insurance over auto accident settlement

WINFIELD--A client is suing his insurance company, alleging it has failed to pay his auto accident settlement in full.

Chad Arthur Klodowski filed a lawsuit Aug. 14 in Putnam Circuit Court against Nationwide Mutual Insurance Company claiming, alleging it has illegally withheld his due settlement check.

According to the complaint, on Sept. 24, 2104, Klodowski was involved in an automobile accident in Putnam County with Patricia Kendrick in which he agreed to an insurance settlement of $20,500 and alleged liens on the settlement were never discussed as part of the stipulation. The suit says Nationwide refused to sign a check of the full amount he was owed and, instead, decided to write a portion of the amount to the plaintiff with the rest going to Medicaid as part of a lien.

Klodowski seeks the full amount of the settlement in one check, as well as damages, inconvenience, loss of interest, attorney fees, court costs, plus any relief the court sees fit. Klodowski is represented by Richard E. Holtzapfel of Holtzapfel Law Office in Hurricane.
