WHEELING – A New Martinsville man is suing Ford Motor Co. claiming his truck was faulty and the company failed to honor the vehicle's warranty.
Timothy A. Carpenter filed a lawsuit in Ohio Circuit Court against Ford Motor Co., citing violations of the West Virginia New Motor Vehicle Warranties Law and the Magnuson-Moss Warranty Act.
Carpenter claims he purchased a 2013 Ford F-150 on April 10, 2014, for $32,002 including a three-year/36,000 mile basic warranty and five-year/60,000 mile powertrain warranty obligating the company to repair any such defects at no cost to Carpenter. Carpenter claims his vehicle has defects not limited to the transmission and brakes and the company failed to repair the problems in a reasonable amount of time as well as delivering it upon the claimed completion with continued defects. The complaint states Carpenter took the truck in for repairs on Oct. 6, 2014, and Nov. 14, 2014.
Carpenter is seeking damages that will fairly compensate him for money or value lost, as well as consequential and/or incidental damages, pre- and post-judgment fees, attorneys' fees, as well as any further relief the court deems fit.
