Relative sues Mercer Nursing and Rehabilitation, alleging poor care

CHARLESTON – A Fayette County woman is suing a Mercer County nursing home facility, alleging her father-in-law was provided with inadequate medical care.

Stephanie Waugh, as power of attorney for Harry Waugh Sr., filed a lawsuit in Kanawha Circuit Court against Mercer Nursing & Rehabilitation Center, doing business as Mercer Nursing & Rehabilitation Center and Wisteria, alleging statutory violations, negligence and reckless misconduct.

According to the complaint, while Waugh Sr. was a resident at the defendant's nursing facility in October-December 2013 he suffered from a fall, urinary tract infection and MRSA infection of the amputation wound site resulting in sepsis. The suit states the defendant failed to take measures as to prevent possible medical problems for Waugh in the future, such as monitoring him so he wouldn't fall or provide him with appropriate hygiene to prevent a UTI.

The suit states the defendant breached its duties as Waugh Sr. was deprived of his right to receive appropriate health care and reside in an environment that would help maintain or enhance his quality of life.  As a result of the defendant's insufficient care, the lawsuit says Waugh Sr. endured physical injuries and pain, mental anguish, physical impairment, medical expenses and loss of life's enjoyment.

Stephanie Waugh seeks damages, plus attorney fees, court costs and other relief deemed appropriate by the court. She is represented by attorneys Andrew L. Paternostro and Jeff D. Stewart of The Bell Law Firm in Charleston. The case has been assigned to Circuit Judge Louis "Duke" Bloom.
