FAYETTEVILLE – A Clay County couple has sued a company and its driver, plus another vehicle operator after the husband allegedly suffered permanent back injuries following an automobile accident.
William George Miller along with his wife Hailey Miller filed a lawsuit in Fayette Circuit Court on Aug. 5 against David Eric Willis; his employer Mine-Weld & Repair, Inc.; and the driver of a third vehicle, Rodney Johnson.
The Millers allege that on Aug. 8, 2013 William Miller was involved in an automobile accident on Cannelton Hollow Road in Fayette County. The Millers allege a truck owned by Mine-Weld and operated by Willis was involved in a crash. William Miller allegedly was forced to stop in the roadway in order to avoid hitting Willis. His vehicle was then hit by another vehicle operated by Johnson.
The Millers allege negligence on behalf of Willis and Johnson caused William Miller to suffer severe and permanent damage to his back that has caused him to receive ongoing medical treatment resulting in thousands of dollars in expenses.
The Millers are seeking all parties both jointly and individually be required to pay for damages incurred to vehicle, as well as all medical expenses, emotional damage, pre- and post-judgment interest, all costs, expenses, and attorney's fees. The Millers are represented by Clinton R. Bischoff and Gregory W. Proles in Summersville, West Virginia.
