MOUNDSVILLE – A financial company is suing a transportation business, seeking payment for a previous judgment from the defendant's former employer.
Livingston Financial filed a lawsuit in Marshall Circuit Court against CSX Transportation Inc., alleging it is negligent in judgment payment.
According to the complaint, Livingston was awarded judgment on July 9, 2009 against Walter C. Breese of $8,823.82, plus interest and cost. The plaintiff alleges that CSX, as employer of Breese, is responsible for the payment, which is currently $12,789.20
Livingston Financial seeks full payment of amount owed, plus further interest incurred, attorney fees and any such other relief the court deems fit. It is represented by attorney Daniel T. Booth of Booth & McCarthy in Bridgeport.
