Woman faults Marten Transport employee with negligent driving

HUNTINGTON – A woman has cited a temperature-sensitive transportation services company and one of its employees for injuries she sustained in a 2013 car accident in Huntington.

 Michelle Anderson filed a lawsuit in Cabell Circuit Court against Marten Transport, Ltd. and Steven Leonard, alleging negligence.

The suit states that Anderson was driving a compact SUV near Fifth Avenue and 31st Street in Huntington on Sept. 17, 2013 when Leonard, who was directly beside Anderson in the right lane, hit her vehicle while operating a tractor truck for Marten Transport. Both of the vehicles were attempting to make a right turn when the collision occurred.

The complaint alleges that Leonard failed to maintain control of his vehicle while turning and was faulted with operating the vehicle in an unsafe manner. The suit said Marten Transport is also responsible for Leonard's negligent actions as he was acting in the scope of his employment with them at the time the accident took place.

Anderson alleges she has and will continue to endure extreme physical and mental pain, a limited ability to attend to her normal daily activities, loss of life's enjoyment, medical expenses, lost wages, and an impaired future earning capacity.

She seeks damages, plus suit costs and other relief deemed appropriate by the court.

Anderson is being represented by Matthew J. Woelfel of Woelfel & Woelfel, LLP in Huntington. The case has been assigned to Circuit Judge Christopher D. Chiles.
