HUNTINGTON -- A Cabell County woman is suing a discount department store, alleging injuries sustained after falling at one of its stores.
Taylor Preece filed a lawsuit July 29 in Cabell Circuit Court against Big Lots Stores, Inc. doing business as Big Lots No. 61, alleging negligence.
According to the complaint, on Feb. 20, Preece, 22, was entering the defendant's Huntington location, 800 14th St. West, when she slipped and fell on a liquid substance.
The suit states Big Lots failed to ensure the safety of its premises by not properly inspecting or maintaining it, allowing a muddy substance to remain on the floor for a considerable amount of time and not implementing precautionary measures to prevent injuries such as by putting up a sign that informed customers of the wet floor.
The plaintiff said she had to undergo knee surgery and physical therapy as the result of the defendant's negligent and reckless actions. She says she has and will continue to endure great pain, as well as medical expenses.
Preece seeks compensatory damages, punitive damages, attorney fees and costs, and other relief deemed appropriate by the court. She is represented by attorney Abraham J. Saad of Saad Dixon Law Offices in Huntington. The case has been assigned to Circuit Judge F. Jane Hustead.
