Poca couple blames town for overflowing storm drains

WINFIELD — Residents allege that the town of Poca is to blame for faulty storm drains that are overflowing and damaging their property. 

Amanda Linville and Kris Bryant filed a suit against the town of Poca in Putnam Circuit Court on Oct. 21, alleging their property has been damaged due to an improperly maintained storm drain. 

The duo claims their property at 175 Poca Circle has incurred extensive flooding to land, residence and personal property starting in March and continuing to the present. The two allege as a result of the town's negligence they have suffered aggravation and annoyance, mental anguish and emotional distress, cost of repair, loss of property value, loss of use of their property, and other out-of-pocket expenses. They allege the town is responsible for the drain system and upkeep, and are therefore at fault. 

The two are seeking judgment in an amount that will fully and fairly compensate them for the damages. They are represented by Thomas H. Peyton of the Peyton Law Firm, PLLC in Nitro. The case has been assigned to Circuit Judge Phillip Stowers.
