Oak Hill woman sues Dollar General, claims she was permanently injured by pipe at store

FAYETTEVILLE – An Oak Hill woman is suing Dollar General claiming she was hit in the head by a pipe that fell from the loading cart in the store.

Betty Abshire filed a lawsuit Oct. 7 in Fayette Circuit Court against Dolgencorp LLC, doing business as Dollar General No. 919, claiming she was permanently injured by a pipe.

Abshire claims on Dec. 9, 2014, while a patron at the Dollar General located at 2013 E. Main St. in Oak Hill she was hit in the head by a pipe that fell from their loading cart. Abshire claims she suffered serious and permanent physical injuries requiring medical treatment, as well as mental anguish, emotional distress, and diminished capacity to enjoy life. Anshire claims she's incurred medical bills of $4,700 plus future payments, and that it was the store's responsibility to keep such dangerous hazards away from customers.

Abshire is seeking compensation for her losses as well as legal interest on special damages from the date of injury, plus costs. Abshire is represented by Kevin B. Burgess and Christopher B. Frost of Hamilton, Burgess, Young & Pollack of Fayetteville. This case is assigned to Circuit Judge Paul M. Blake Jr.
