Woman accuses Division of Corrections, officer off sexual assault

CHARLESTON - A former prisoner is suing corrections officer and the prison claiming she was sexually assaulted while incarcerated.

Elizabeth Chinn filed a lawsuit on Sept. 23 in Kanawha Circuit Court against David Martin, The West Virginia Division of Corrections, and John Doe claiming she was sexually harassed, abused and exploited while a prisoner at Lakin Correctional Center.

Chinn claims she was repeatedly approached by Martin who was seeking sexual favors while acting as a corrections officer, the complaint states. Chinn goes on the claim that Doe was the supervisor of Martin and did nothing to stop the unwanted attention or behavior. Chinn alleges that while under supervision of Martin and Doe she was inflicted with substantial injury due to unwanted sexual attention and abuse.

Chinn is seeking judgment against the defendants jointly and and severally, compensatory and punitive, attorneys' fees, court costs, and any such relief the court sees fit. She is represented by Michael A. Woelfel of Woelfel & Woelfel LLP, of Huntington. The case is assigned to Circuit Judge James C. Stucky.
