Human Rights Commission employee sues for thousands of dollars in back pay

CHARLESTON – A Kanawha County woman is suing the Human Rights Commission, claiming she is owed several thousands in back pay.

Mary Poke filed a lawsuit Sept. 18 in Kanawha Circuit Court against the West Virginia Human Rights Commission claiming that she was fired, ordered to be reinstated and paid back pay but has yet to receive any payments.

Poke claims she was employed by the commission as an investigator from Aug. 1, 2013, until she was fired on March 11, 2014. Poke claims she pursued a challenged to her discharge, was granted reinstatement to position as well as back pay but has yet to be contacted by the agency nor receive payment.

Poke claims she has suffered damages resulting from the commission's negligence to follow orders in the amount of $33,177.34, as well as three times liquidated damages $99,532.03, statutory interest on all unpaid amounts and attorney's fees. Poke is represented by Mark A. Toor of Charleston.
