Woman claims Family Dollar fired her after being injured on the job

FAYETTEVILLE – A Fayetteville woman is suing Family Dollar over claims the company unlawfully fired her after being injured on the job.

Shannon Coley filed a lawsuit on Oct. 29 in Fayette Circuit Court against Family Dollar Stores of West Virginia Inc., citing discrimination.

Coley claims she was an employed by the Fayette County location as a cashier in 2013 and was soon promoted to assistant manager when on Feb. 2, 2014, she suffered a work-related injury. Coley claims she applied for workers' compensation and was then limited to restrictive lifting of no more than 5 pounds. Coley alleges her supervisors told her she could no longer work with those limitations and would have to either take medical leave or quit, and claims she was subsequently taken off of the schedule on Sept. 6. Coley believes she was terminated because of the workers' compensation claim.

Coley is seeking compensation for annoyance, aggravation, lost wages, fees and costs and other harm incurred. She is represented by Greg A. Hewitt of Hewitt & Salvatore in Fayetteville.

The case has been assigned to Circuit Judge Paul M. Blake Jr.
