South Branch Inn sued over injuries allegedly caused by poorly maintained property

ROMNEY – An Elkins man is suing a hotel over claims that he was injured on their poorly maintained property.

Jackie W. Hinchman Sr. filed a lawsuit on Oct. 22 in Hampshire Circuit Court against South Branch Inn Inc., and John Doe, citing negligence.

Hinchman claims on Jan. 24, 2014, he was walking on South Branch Inn parking lot, located at 1500 U.S. Highway 220 N., Moorefield, when he fell and was injured. Hinchman claims he fell because of an accumulation of ice and snow which should not have been present, and would not have been if the management of the establishment would not have been negligent.

Hinchman is seeking compensatory damages for past, present, and future medical bills and relief; general damages for past, present, and future suffering, mental anguish, injury, inconvenience, loss of society, service, and companionship, and loss of enjoyment of life; as well as prejudgment and post-judgment interest; costs and attorneys' fees, and any other relief the court sees fit.

Hinchman is represented by James A. Villanova and Michael E. Metro of Villanova Law Offices P.C. in Pittsburgh. The case has been assigned to Circuit Judge Charles E. Parsons.
