Proctor couple claims plant explosion caused damage to their property

MOUNDSVILLE – A Wetzel County couple is suing processing plant claiming an explosion seriously damaged their property.

Dorman Davisson and Lori Davisson filed a lawsuit on Oct. 22 in Marshall Circuit Court against Blue Racer Mainstream, LLC, claiming their property has been damaged by flames and fumed emitted by the company's processing plant.

The couple claims that on Sept. 21, 2013, their Proctor property was damaged by smoke, fumes, dust, dirt and debris coming from an explosion and fire at the plant. The couple goes on the claim they have reason to believe that another explosion and fire could happen and cause more damage to their property, and that this has not only led to physical damage of their home and property but also emotional and mental anguish and marital strife.

The Davissons are seeking compensatory, general, and punitive damages, prejudgment and post-judgment interest, attorneys' fees and costs, and any other relief the court sees fir. The couple is represented by James G. Bordas and Jeremy M. Mcgraw of Bordas & Bordas PLLC of Wheeling. The case has been assigned to Circuit Judge David W. Hummel Jr.
