POINT PLEASANT – A Gallipolis, Ohio husband and wife claims that harmful gasses were negligently released at the husband's job site, injuring him.
Robert L. Donnet and Melba Jane Shelnut filed a lawsuit on Oct. 22 in Mason Circuit Court against ICL-IP America Inc, citing negligence and loss of consortium.
The couple claims Donnet was working as a painter on the defendant's property on June 19, 2014, when he inhaled and breathed in gas and chemical fumes that the suit claims the defendant negligently allowed into the work area, which caused him to suffer an immediate and serious adverse reaction. The couple claims Donnet suffered permanent physical impairment, pain and suffering, mental anguish, past and future lost wages, medical expenses and loss of enjoyment of life as a result.
The duo is seeking compensatory damages for injures and damages suffered, exemplary damages, court costs and attorneys' fees, as well as any other relief the court sees fit. The couple is represented by Edwin H. Pancake of Maroney, Williams, Weaver, & Pancake, PLLC in Charleston. The case has been assigned to Circuit Judge Thomas C. Evans III.
