Woman claims neighbor erected a fence on her property

PRINCETON – A Mercer County woman is suing over claims that her neighbor erected an illegal fence.

Shirley Wistrand filed a lawsuit on Oct. 28 in Mercer Circuit Court against Thomas R. Gilpin Jr. and Travis Estip, citing trespass and conversion.

Wistrand claims she owns property in White Oak Valley Subdivision named Lot 116A and that Gilpin owns Lot 115. Wistrand alleges Estip occupied the property owned by Gilpin and at one point constructed a border fence that unlawfully encroached onto her property and also removed soil.

Wistrand is seeking an injunction to stop construction and remove the fence, as well as judgment of defendants both jointly and severely in an amount to compensate her damage, prejudgment and post-judgment interest, costs and attorneys' fees, and any other relief the court sees fit.

Wistrand is represented by Derrick W. Lefler of Derrick W. Lefler Attorney of Law in Princeton. The case has been assigned to Circuit Judge Omar J. Aboulhoson.
