PRINCETON – A couple that purchased a GMC truck claims the vehicle is faulty and has yet to be repaired despite multiple attempts.
Tulio Anthony Remella Jr. and Mandy M. Ramella filed a lawsuit on Nov. 5 in Mercer Circuit Court against General Motors LLC, citing breach of contract and breach of warranty.
The couple claims that on Oct. 11, 2014, they purchased a 2014 GMC Sahara pickup truck from Cole Chevrolet-Cadillac, an authorized GMC dealer. The couple alleges that since the purchase of their vehicle, which is covered under GMC's Bumper-to-Bumper warranty plan, they've returned to the dealership on seven occasions to repair the transmission. The claim states that the transmission unexpectedly shifts into neutral while in use, and claim that this is because of the negligent manufacturing of the vehicle.
The couple is seeking refund of the purchase price of the vehicle, including sales tax, registration, and licenses, damages for loss of use, annoyance and inconvenience, attorneys' fees and costs, interest, and any further relief the court sees fit. The Ramellas are represented by C. William David of Richardson & Davis PLLC in Bluefield. The case has been assigned to Circuit Judge Omar J. Aboulhosn.
