Couple claims car is grossly defected, sues GMC dealership

KINGWOOD – A Tunnelton couple claims a car they purchased at Astro GMC is defective and is suing over fraud allegations.

Jamie L. Bolyard and Bryan J. Bolyard filed a lawsuit on Oct. 27 in Preston Circuit Court against Astro I Inc., doing business as Astro @ Exit 132 Buick GMC, citing fraud, breach of implied warranty, breach of contract, violations of the West Virginia Consumer Credit and Protection Act and other counts.

The couple claims that on April 11, 2014, they went to the Astro Buick GMC located at 2238 White Hall Blvd. in White Hall to purchase a used 2012 Jeep Patriot. They claim that upon purchase their total cost was more than $20,000 and was padded with an additional $1,000 in unexplained costs and $700 in GAP insurance that they did not request. They also allege that the vehicle was defective and continually had problems post-purchase.

The couple is seeking equitable relief, accidental, incidental, and consequential damages, attorneys' fees and costs, and other relief the Court sees fit. The couple is represented by Sara Bird of Mountain State Justice in Clarksburg.
