Construction company sues Wal-Mart claiming it's owed thousands for project

WINFIELD – The Hurricane Walmart store is being sued over claims it failed to pay a company after a construction project.

Cherry River Construction LLC filed a lawsuit on Oct. 29 in Putnam Circuit Court against Wal-Mart Stores Inc., citing breach of contract.

The company claims it signed on as a sub-contractor to work on the property located at 167 Progress Way, Hurricane, and that upon completion of the contracted work it has only been paid a portion of the total amount of $174,000.

The company is seeking payment of the remainder of the bill in the amount of $77,233.08, as well as costs and attorneys' fees and prejudgment interest. The company is represented by Michael P. Markins and Jennifer A. Lynch, of Mannion, Gray, Uhl, & Hill Co, LPA of Charleston.
