Woman sues Kroger claiming floor caused her fall

WINFIELD – A Hurricane woman is suing Kroger claiming her injury is because of the store's negligence.

Agatha B. Worley filed a lawsuit on Nov. 6 in Putnam County Circuit Court against The Kroger Co., Kroger Limited Partnership I, KRGP Inc., and John Doe, citing negligence.

Worley claims that on April 25 while shopping at the Kroger at 402 Great Teays Boulevard in Scott Depot, she tripped and fell over an indention on the floor and fractured her wrist and hip in the process. Worley claims her injury required medical attention and could have been prevented if not for the store's negligence.

Worley is seeking judgment from each defendant in an amount to fairly compensate her for damages and injuries, as well as costs and attorney's fees, and any other relief the court sees fit. Worley is represented by Bernard E. Layne III of Mani, Ellis, & Layne of Charleston. The case has been assigned to Circuit Judge Joseph Reeder.
