Woman sues mobile home owner after fall

HUNTINGTON – A woman claims she sustained permanent injuries from a fall in mobile home that could have been prevented.

Janice Ferguson filed a lawsuit on Oct. 29 in Cabell Circuit Court against Eugene Potter, citing negligence.

Ferguson claims that on Nov. 1, 2013, while residing in a mobile home owned by Potter,  she fell and was injured because of the poorly maintained floor. Ferguson claims that her fall was caused by the neglect of the flooring in the mobile home and her injuries could have been prevented had proper maintenance been performed. The complaint states that Potter was notified of the floor's condition.

Ferguson is seeking judgment against Potter in a sum of excess of the court's minimal limit, costs, interest, and any other relief the court sees fit. This case is being heard by Judge Chris Chiles. Ferguson is represented by Matthew J. Woelfel of Woelfel & Woelfel LLP in Huntington.
