Family Dollar sued by former employee over age discrimination claims

PINEVILLE – A former employee is suing Family Dollar claiming she was unlawfully fired because of her age.

Linda Toler filed a lawsuit on Oct. 27 in Wyoming Circuit Court against Family Dollar Operations Inc. and Phyllis Hodge, citing age discrimination.

Toler, 60, claims she was hired as a manager at the Family Dollar Store number 1926 in Oceana on Sept. 25, 2004, and that prior to Nov. 19, 2014, had never had any professional problems. Toler alleges that on that date she was approached by her supervisor, Hodge, and asked about her retirement plans. She told Hodge that she did not intend to retire in the near future. The complaint states that shortly afterward, she was written up for falsified allegations and subsequently terminated on Jan. 7. The complaint states that a younger employee was hired in Toler's place.

Toler is seeking compensation of lost wages and benefits, emotional distress, humiliation, mental anguish, front pay and future losses on earnings, punitive damages, costs and attorneys' fees, as well as any other relief the court sees fit. Toler is represented by Robert P. Dunlap II of Beckley.
