Coal City couple claims construction companies failed to complete sewage project, sues for damages

Contract breach

BECKLEY – A Coal City couple claims a construction company failed to complete contracted project.

Stephen R. McMillion and Deborah McMillion filed a lawsuit on Nov. 5 in Raleigh Circuit Court against J&J Paving, J&J Paving & Asphalt LLC, Daniel Bishop and Jake Boswell claiming negligence, liability and breach of contract.

The McMillions claims they hired the company in February and its workers as contractors to install a sewage system that would correct the unsanitary conditions presently on the property, and goes on to claim that the work was never properly completed in compliance with laws and regulations of the Beckley Raleigh County Health Department.

The McMillions are seeking judgment against the defendants jointly and severely, compensatory damages, interest, attorneys' fees, costs of suit, and any other relief the court sees fit. The couple is represented by Anthony J. Sparacino Jr. of Beckley. The case has been assigned to Circuit Judge H.L. Kirkpatrick III.
