Ohio Steel accused of not delivering promised building

FAYETTEVILLE —A Mt. Hope company alleges it is owed tens of thousands of dollars in construction materials.

The owners of American Refractory Company LLC. filed a lawsuit on Dec. 4 in Fayette Circuit Court against Ohio Steel Construction LLC, alleging it has yet to receive products purchased and paid for.

American Refractory's owners allege that on April 7 the company paid $12,386 for steel buildings from Ohio Steel, but has still not received the order even though the construction company deposited the check.

The plaintiff is seeking the full amount of $12,386 with pre-judgment and post judgment interest, court costs and attorneys' fees, and any other relief the court sees fit. American Refractory is represented by Clyde A. Smith Jr. of Roop and Smith Law Offices LLPC in Beckley.
