Couple claims American Modern Home Insurance Co. failed to pay full coverage

LOGAN – A Logan County couple claims its insurance company failed to pay the full due amount for a claim.

Carolyn Queen and Jerry Queen filed a lawsuit on Dec. 3 in Logan Circuit Court against American Modern Home Insurance Co. and Shaun Bose, citing negligence, breach of duty, bad faith and violations of the West Virginia Unfair Trade Practices Act.

The couple claims that on June 8 a neighbor's tree fell and damaged their property and that they quickly notified AMHIC about their loss. The complaint states that Bose was assigned as the adjuster, and that although some of the payments have been made, they've yet to receive all that is due. The Queens also seek an itemization of payments for ongoing litigation with the neighbor.

The Queens are seeking compensatory damages in an amount in excess of of the court's jurisdictional limits, attorneys' fees and costs, annoyance and inconvenience, emotional distress, net economic losses and other losses lost, as well as punitive damages against defendants. The Queens are represented by Scott H. Kaminski of Balgo & Kaminski in Charleston. The case has been assigned to Circuit Judge William Douglas Witten.
