Ohio woman claims Mountaineer Race Track and Gaming Resort's negligence caused fall

NEW CUMBERLAND – An Ohio woman is suing over injuries she claims she suffered when she fell at a casino hotel.

Enice Boyde of Steubenville filed the suit Nov. 25 in Hancock Circuit Court against Mountaineer Park Inc. and MTR Gaming Group Inc. of Chester, both doing business as The Mountaineer Race Track and Gaming Resort.

On March 27, the suit states, the plaintiff, who was at the defendants' casino hotel, fell while using the hotel entrance. Her subsequent injuries occurred as a result of the negligent, careless and reckless conduct of the defendants, the suit claims.

She has been injured and disabled, had to seek medical treatment and incur expenses and has endured mental anguish, aggravation, the loss of enjoyment of life and the loss of the ability to function.

The plaintiff seeks maximum damages, attorney fees and court costs. She is represented by Kevin M. Pearl or Frankovitch, Anetakis, Colantonio & Simon of Weirton. The case is being heard by Circuit Judge Jason A. Cuomo.
