Plateau Electric employee demands trial in workplace injury case

BECKLEY – A Fayette County man is seeking compensation from two area businesses, alleging an April workplace accident left him unable to work for the foreseeable future.

Mickey Bragg filed a lawsuit on Nov. 3 in Raleigh Circuit Court against Plateau Electric Inc. of Scarbro, doing business locally from Dothan, and Danhill Construction Co. of Glen Faris. The lawsuit alleges deliberate intent against Plateau Electric and both negligence and willful, wanton, reckless conduct against Danhill Construction.

According to the complaint, Bragg was working on an elevated scissor lift removing electrical wiring from the Raleigh County Board of Education building last April when an incident reportedly involving the removed wire, a moving vehicle and a faulty lift allegedly caused him to fall approximately 16 to 18 feet to the ground. Bragg sustained a complex, comminuted fracture to his right leg and ankle as well as compression fractures to two vertebrae in his back and a concussion. His injuries allegedly resulted in permanent bodily damage that has left him unable to work or perform daily living tasks.

Bragg seeks a trial by jury, compensation for injuries, losses and damages as well as attorney fees and costs from both defendants plus a punitive judgement against Danhill Construction. He is represented in the case by attorney Lynnette Simon Marshall and Robert B. Warner of Warner Law Offices PLLC in Charleston. The case is being heard by Circuit Judge John A. Hutchison.
