Former employee accuses Bob Evans of violating WVWPCA

WHEELING – An Ohio County man is suing over claims of not receiving his final paycheck in a timely manner as required by the West Virginia Wage Payment and Collection Act.

Robert Findley filed the suit Dec. 18 in Ohio Circuit Court against Bob Evans Farms, citing violation of the WVWPCA.

The plaintiff began working for the defendant's Ohio County location on July 23, 2009. On March 26, the defendant terminated the plaintiff's employment. However, the plaintiff did not receive all his final pay from the defendant when the law required.

He is seeking damages, including liquidated damages, interest, court costs and attorney fees. In addition, the plaintiff is not seeking damages of more than $75,000. He also seeks a trial by jury. The plaintiff is represented by Sandra K. Law of Schrader Byrd & Companion of Wheeling. The case has been assigned to Circuit Judge James P. Mazzone.
