Nurse demands compensation over allegations of unsafe workplace and sexual assault

PRINCETON – A Mercer County nurse is suing a local hospital and a physician over claims she was sexually assaulted at her workplace.

The plaintiff filed a suit in Mercer Circuit Court on Nov. 30 against Bluefield Hospital Co. LLC, doing business as Bluefield Regional Medical Center; Onyx Healthcare Inc., doing business as Onyx M.D.; Alan Zarkower; and John Doe Onyx. Citing a hostile work environment, negligent hiring and sexual harassment charges, the plaintiff alleges personal injury to her physical and emotional well-being.

On Dec. 18, 2013, the plaintiff claims Dr. Alan Zarkower approached her without warning or permission and committed an act of assault and battery of a sexual nature to her person. At the time of the alleged attack, she was performing her duties as a nurse aesthetician at the Bluefield Regional Medical Center.

The plaintiff accuses the defendants with providing a work environment that included frequent and unwelcome sexual advances, of both of physical and verbal nature, which were offensive and emotionally distressing. She holds Zarkower responsible for such damages, acting as agent, but also seeks compensation from the hospital, which allegedly ignored claims and allowed for such behavior to take place.

The plaintiff seeks compensation from all defendants for punitive damages, litigation fees and both prejudgment and post-judgment interest. She is represented by Marvin W. Masters of the Masters Law Firm in Charleston. The case has been assigned to Circuit Judge Omar J. Aboulhosn.
