FAYETTEVILLE – A Fayette equipment company is seeking compensation for alleged unpaid services provided to a West Virginia trucking company.
Leslie Equipment Co. filed a claim Dec. 23 in Fayette Circuit Court against Grimmett Trucking LLC and Thomas A. Grimmett, alleging a breach of contract and refusal to pay due sums.
According to the complaint, the defendant entered into a legally binding contract on March 12, 2015, to pay for services and equipment provided by Leslie Equipment Co. Grimmett personally has also failed to provide payments that he allegedly guaranteed to the plaintiff. As of Nov. 12, the plaintiff claims the defendant owes $11,123.92 for cost of services, equipment and interest.
Leslie Equipment seeks all charges for equipment and services agreed upon in the aforementioned contract, along with contractual interest, post-judgment interest, attorney’s fees and collection costs. The plaintiff is represented by Jason S. Hammond of Bailey and Wyant PLLC in Charleston. The case has been assigned to Circuit Judge Paul M. Blake Jr.
