Blue Racer Midstream sued by employee over age discrimination allegations

MOUNDSVILLE – An employee is suing Blue Racer Midstream claiming he was victim of workplace bullying and that his age was a factor.

Stephen Ledergerber filed a lawsuit on Dec. 17 in Marshall Circuit Court against Blue Racer Midstream LLC, Alan Ball and John Burgess, citing retaliatory action; defamation, libel, slander and/or false light; and age discrimination.

Ledergerber, 55 at the time of his employment, claims that while employed at Blue Racer's Natrium facility as a senior lab technician he alerted management staff about safety concerns in the fall of 2015, and was confronted with harassment and bullying from his direct superiors. He alleges he was both verbally and in writing warned that he should look for another employment option, and that his age may have played a role in this abuse. Ball and Burgess were Ledergerber's supervisors.

Ledergerber is seeking compensation of general and economic losses, punitive damages, pre-judgment interest, attorney's fees and costs, and any such further relief the court deems fit. Ledergerber is represented by Nicholas A. Wininsky of Wininsky Law Offices in Pittsburgh. The case has been assigned to Circuit Judge Jeffrey Cramer.
