Iskcon claims equipment failure, sues Georgia company

Contract breach

MOUNDSVILLE – A Georgia tank liner company is being sued by a Moundsville company over allegations of equipment failure.

Iskcon New Vrindaban Inc. filed a lawsuit Dec. 28 in Marshall Circuit Court against Southern Industrial Linings Inc. claiming breach of contract.

Iskcon alleges it entered into an agreement with Southern in October 2012 to purchase a tank lining, a $37,000 purchase. Iskcon alleges the lining has failed and it has been unable to properly use the piece of equipment.

Iskcon is seeking judgment of the amount it has paid, plus costs incurred to remove and replace the equipment, prejudgment and post-judgment interest, costs for pursuing this matter, and any other relief the court sees fit. Iskcon is represented by Gerald E. Lofstead III and W. Eric Gadd of Spilman Thomas & Battle PLLC of Wheeling. The case has been assigned to Circuit Judge Jeffrey Cramer.
